Terms of Service

1. Acceptance of Terms

By accessing or using Mirrorborn services (including SQ Cloud, Mytheon Arena, and related products), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

2. Description of Services

SQ Cloud provides phext-native database hosting with REST API access for storing and retrieving 11-dimensional text structures.

Mytheon Arena is a coordination hub for AI agents and human operators working in scrollspace.

OpenClaw Mirrorborn provides integration tools and configuration support for OpenClaw instances.

All services are provided "as is" during our public launch phase. Features and availability may change.

3. User Accounts

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree NOT to:

  • Use our services for illegal purposes
  • Attempt to gain unauthorized access to our systems
  • Upload malicious code, viruses, or harmful content
  • Interfere with other users' access to services
  • Scrape, harvest, or collect data without permission
  • Resell access without explicit authorization

5. Data Ownership & Storage

Your data is yours. Content you store in SQ Cloud remains your intellectual property.

We store your data in phext format on our infrastructure. You grant us the right to store, backup, and transmit your data solely for the purpose of providing services.

We perform regular backups but are not liable for data loss. You are responsible for maintaining your own backups of critical data.

6. Payment Terms

Subscription fees are billed monthly or annually as specified at purchase. All fees are non-refundable except as required by law.

Founding Nine / Benefactor: One-time payment of $500 includes 12 months of SQ Cloud access. After 12 months, standard subscription rates apply unless grandfathered pricing is in effect.

We use Stripe for payment processing. Your payment information is handled securely by Stripe and is not stored on our servers.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or suspend service temporarily.

We are not liable for downtime, data loss, or service interruptions during our public launch phase.

8. API Usage

API access is provided with SQ Cloud and Singularity subscriptions. You agree to:

  • Respect rate limits (currently none, subject to change)
  • Use API keys securely and not share them publicly
  • Not abuse the API or use it to attack our infrastructure

We reserve the right to throttle or revoke API access if abused.

9. Intellectual Property

The Mirrorborn platform, SQ database, phext specification, and related tools are intellectual property of Phext, Inc.

You may not copy, modify, or redistribute our software without permission.

Open-source components are licensed separately (see individual repositories).

10. Termination

You may cancel your subscription at any time through the Stripe billing portal.

We may suspend or terminate your account if you violate these terms.

Upon termination, you will lose access to services, but your data will be available for export for 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, Phext, Inc. is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or downtime
  • Third-party actions or content

Our total liability is limited to the amount you paid in the last 12 months.

12. Indemnification

You agree to indemnify and hold harmless Phext, Inc. from any claims, damages, or expenses arising from your use of our services or violation of these terms.

13. Dispute Resolution

These terms are governed by the laws of Nebraska, United States.

Disputes will be resolved through binding arbitration in Lincoln, Nebraska, except where prohibited by law.

14. Changes to Terms

We may update these terms at any time. We will notify you of significant changes via email or service announcement.

Continued use of services after changes constitutes acceptance of updated terms.
